Man to serve 15 years for wife’s murder

A 32-year-old hawker who killed his estranged wife by stabbing her with a knife following a domestic feud will serve 15 years in jail.
Eldoret High Court judge Olga Sewe handed Andrew Musaina the sentence saying the offence was serious and carried a death sentence.
She, however, said that she avoided sentencing the accused to death after considering his mitigation and pleadings before delivering her judgment.
Musaina stabbed the former wife, Sydney Khaisa, a mother of one, several times after a scuffle arose between them.
She was taken to Kapsabet County Referral Hospital by neighbours, but succumbed to the injuries the following day.
Musaina, who was represented by lawyer Nathan Oburu committed the offence on November 12, 2011 at Kaptobongen area in the outskirts of Kapsabet town in Nandi county. The deceased had been sent to the shop by her father but on her way back, she met the accused person who asked her to stop so that they sort out a few issues.
The court heard that it was during the conversation that the accused removed a knife from his pocket and stabbed the victim several times.
Lady Justice Sewe said Musaina escaped death sentence because he was remorseful.
