Meru businessman, politician and disability activist Michael Mutembei Makarina has threatened to take legal action against Meru County Assembly Speaker Ayub Bundi if he fails to explain the expenses incurred by the assembly in the five impeachment motions against Meru Governor Kawira Mwangaza.

In his petition, Makarina said his request was made pursuant to Article 35 of the Constitution of Kenya, which grants citizens the right to access information held by the State.

“Article 35(1) of the Constitution states that every Kenyan Citizen has the right of access to -(a) information held by the state; and (b) information held by another person and required for the exercise or protection of any right or fundamental freedom. Article 35(3) further states that the State shall publish and publicise any important information affecting the nation,” he said.

He demanded a comprehensive breakdown of all costs associated with these impeachment proceedings, including but not limited to all legal expenses incurred by the County Assembly at the High Court, County Assembly and the Senate including consultancy costs.

“We also demand to know travel and accommodation allowances incurred by the Members of County Assembly of Meru sponsored under the auspices of the Meru County Assembly to attend the impeachment motions at the Senate, administrative and operational costs incurred by the County Assembly, and any other appurtenant expenses,” said Makarina in his petition.
