Man jailed for three years for assault on his girlfriend’s lover

An Eldoret court has sentenced a man to three years in jail after he was found guilty of assaulting another man for eloping with his 17-year-old girlfriend.


Emmanuel Sidai , 23 shocked the court when he said that he engaged the complainant in a fight after being tipped off that he was behind the disappearance of his lover.

Sidai, who was unrepresented, appeared before Eldoret Senior Principal Magistrate, Richard Odenyo where he pleaded guilty to the assault charge.


The court heard that on May 17, 2023 at Kambi Mawe village in Tapsagoi location within Turbo sub county, he wilfully and unlawfully assaulted Ezekiel Aluvale, thereby accessioning him actual bodily harm contrary to section 251 of the penal code.


While reading the facts of the case, Gladys Kenei, told the court that the accused stormed into the house of the complainant where he found him having a good time with his girlfriend which angered him.
He proceeded to hit Aluvale with a blunt object and destroyed a television set belonging to the complainant.


Aluvale was critically injured and was rushed to Moi Teaching and Referral Hospital in Eldoret for treatment.


He was admitted in the hospital for almost two months before being discharged.


The accused was also charged with malicious damage to property. He pleaded guilty to the charges.
He has fourteen days to appeal the sentence.
