A Nairobi court has sentenced a man who was convicted of stealing roasted groundnuts worth Sh6,000 to serve two years on probation.

In delivering the sentence, Milimani Senior Principal Magistrate Benmark Ekhumbi (pictured) considered the period that the accused had been in custody and the mitigation he presented before the court.

“Considering the mitigations by the accused and the time he has spent in custody, he will serve two years probation sentence,” said the magistrate.

Daniel Mukuwana pleaded guilty to the charges presented by the prosecution against him of stealing 15 Kg of roasted groundnuts worth Sh6,000.

According to the complainant, Mukuwana is well known to her since he worked as a casual worker in Tsunami market where the offence took place.

Judy Wanjiru Mburu who is the complainant in the matter stated; “I have been employing him to roast groundnuts and packaging and is a well known in Tsunami market.”

The court heard that Mukuwana broke into the shop by cutting the padlock and committed the said offence.

Roasted groundnuts

The prosecution told the court that on May 6, 2024 at Tsunami Market within Nairobi county, the accused broke into Wanjiru’s shop and steal the roasted groundnuts worth Sh6,000.

The accused stole 32 pieces of roasted groundnuts which was brought before court.

In mitigation, Mukuwana expressed remorse for his actions and requested the court’s leniency.

He took responsibility for his crime and acknowledged the impact of his actions on the complainant.

Mukuwana told Ekhumbi that he committed the offence out of desperation since his mother is sick and he had no money to go to the village to take care of her.

“Your honor my mother back in the village is sick and I wanted to go to see her but I had no money,” he said.

He told the court that he is a peasant working as a casual worker to roast groundnuts in Tsunami market where he earns a meager salary.
