Former PC to take plea in Sh1.3b land fraud case
A Nairobi court will on Thursday visit former Nairobi Provincial Commissioner Davis Chelogoi’s home to plead to charges of conspiracy to defraud a businessman 7.39 hectares of land valued at Sh1.35 billion located at Lower Kabete area.
When the matter came up for plea taking, through his lawyer Prof Tom Ojienda, Chelogoi told Milimani Senior Principal Magistrate Dolphina Alego (pictured) to defer the matter on grounds that he is still unwell.
But the prosecution opposed the application for adjournment, and asked the court to order an investigating officer to visit Chelogoi wherever he is and make a report before the court issues further orders.
Court was told that Chelogoi has been avoiding to take plea since November last year.
“My client is still sick as per his medical documents from his doctor at Kenyatta National Hospital. We are seeking a deferral of the case,” Ojienda said.
However, the magistrate, in her brief ruling, directed the court to move to wherever Chelogoi is at 10 am tomorrow and take his plea in the case.
