The High Court has ordered the Inspector General of Police Japhet Koome, Attorney General Justin Muturi and three others to respond to a petition filed by Busia Senator Okiya Omtatah over failure to record his statement following alleged death threats by President William Ruto.

Justice Chacha Mwita of the High Court Constitutional and Human Rights Division ordered Muturi, Koome and his deputy, DCI boss Amin Mohammed, Nyanchwa OCPD Kazungu Charo and the Kenya Police Service to file their responses within two weeks to the lawsuit lodged by Omtatah for declining to record his statement against the Head of the State.

“I hereby order the respondents herein to file responses to the petition be filed within 14 days after being served with the pleading, the matter be mentioned on January 24, 2024 for directions before Justice Lawrence Mugambi,” Justice Mwita stated.

The court’s directions came after Omtatah on December 29, 2023 moved to court seeking orders compelling the Inspector General of Police and his junior officers to record his statement over death threats from the President for successively prosecuting the case challenging the Housing Levy.
