Court suspends appointment of Nairobi liquor bosses

The Employment and Labour Relations Court has suspended a Gazette Notice that announced the appointment of members of Nairobi City Sub-County Alcoholic Drinks and Licensing Committees.

Justice Nduma Nderi suspended Nairobi County Assembly Speaker Benson Mutura’s appointment pending the hearing of a suit filed by two petitioners; Eric Kiogora and Stephen Mwangi.

 “It is hereby ordered that pending the inter partes hearing and determination of this Application and Petition, conservatory orders be and are hereby issued suspending Gazette Notice No.86 of January 12, announcing that the Second Respondent has appointed members of Nairobi City Sub-County Alcoholic Drinks and Licensing Committees,” the court order. 

Judge directed the Respondent to file a response to the Petition within 14 days. City County Government, acting Governor, Chief Officer for Commerce and Indutrialisation have been named as Respondents in the petition.

Judgement has been set for March 22. Kiogora and Mwangi accuse the Speaker of breaching the contracts of the Board members who were in office at the time he issued the notice.
