A judge has ordered a Rwandese investor to pay the High Court Sh1,000 for wasting it is time.
Justice Alfred Mabeya also slapped Desire Muhinyuza with a Sh30,000 fine for causing unnecessary adjournment and filing of documents out of time.


The Sh30,000 with be paid to Kenyan businessman Kirimi Koome as compensation for wasting his time.
“I hereby order the Plaintiff (Desire Muhinyuza) to pay the Defendant Sh30,000 for causing adjournment and Sh1,000 to the court. Hearing to proceed without further delay,” Mabeya directed.


Outside timelines


Justice made the orders after city lawyer Danstan Omari filed his documents outside timelines granted by the court necessitating an adjournment.

The orders were issued after Koome’s defence, led by lawyer Cliff Ombeta and Jackson Omwanza, protested the move by Omari to file his pleadings late, adding that the court’s time is being wasted by Rwandan national who has been dragging his client into court, seeking to regain control of his company known as Stay Online Limited.


However, DCI urged the court to admit the documents filed late, adding that Koome and respondents will not suffer any prejudice. Let each party be allowed to Koome to respond.


In the case, Koome and Muhinyuza are fighting over the company.


Hearing continues today where Koome is expected to testify.


The by Muhinyuza comes after another a judge in the same Commericial and Tax Divison found that Koome is the registered owner of Stay Online Limited.


Justice Josephine Mongare ruled that Koome remains the true owner of Stay Online Limited where Sh400 million belonging to the firm is held at United Bank of Africa.


Mongare made the finding after dismissing the petition filed by Ambrose Wamari Obara.
In her decision, the judge found that Obara was not properly installed as the owner and director as he had al-leged.
