Court denied access to former city PC
A Nairobi court was yesterday denied access to former Nairobi Provincial Commission Davis Chelogoi who is admitted in hospital.
Court had gone to Nairobi Hospital to have Chelogoi plead to charges of conspiracy to defraud a businessman of 7.39 hectares of land in Lower Kabete valued at Sh1.35 billion.
Drama ensued when Trial Magistrate Dolphina Alego, Chelogoi’s lawyer Tom Ojienda and the complainant, Ashok Shah’s lawyer Suleiman Bashir attempted to access the accused’s ward, only to be stopped by hawk-eyed security officers, saying they were not aware of the visit.
Officers said the court ought to have notified hospital management of the planned visit.
Alego had earlier this week directed that the court would visit Chelogoi “wherever he is” to take a plea following repeated adjournments in the case owing to his unavailability.
Ojienda had sought the court’s indulgence to defer the plea taking on grounds that his client was indisposed.
Shah’s lawyer Bashir, while addressing the media outside the court, expressed his frustration with actions of the suspect, terming them delaying tactics.
In the case, Chelogoi is to be charged alongside Deputy Land Registrar Andrew Aseri Kirungu with conspiracy to defraud Ashok and Hitenkumar Amritlal Raja of their parcel of land valued at Sh1,350,000,000.
Chelogoi separately faces a charge of forcible detention of the said land where the prosecution claims he unlawfully detained the land on unknown dates between December 9, 2020 and December 12, 2023.
