2 KDF officers among 5 charged in Kitengela burglary plot

Five people, among them two Kenya Defence Forces (KDF) officers, have been charged before a Nairobi court with intent to break into George Okumu Opondo’s house at the Acacia Paradise Estate in Kitengela town.

According to the prosecution, the five, Charles Kiio Matata, David Ng’aa Mwangangi, Alex Mumo Kisilu, Richard Mwania Muasya and Stella Nzuki Mweni, were arrested while preparing to commit a felony contrary to Section 308(1) of the Penal Code.

The Directorate of Public Prosecution (DPP) states in its charge sheet that the accused persons were cornered on March 25, 2026, while armed with dangerous weapons that they would have allegedly used to break into Opondo’s house.

“On March 25, 2026, at Acacia Paradise Estate in Kitengela town within the Republic of Kenya, jointly with others, you were found with dangerous weapons, namely a claw bar, a claw hammer, one USA Super knife and pliers in circumstances that you were armed with intent to commit a felony, namely housebreaking,” part of the charge sheet reads.

On the other count, the accused persons have been charged with conspiracy to commit a felony contrary to Section 393 of the Penal Code.

The prosecution avers that the five, jointly with others not before the court, on March 18, 2026, conspired to break into Opondo’s house in Kitengela town.

“Between March 18, 2026, and March 25, 2026, within the Republic of Kenya, jointly with others not before the court, conspired to commit a felony, namely breaking into the house of George Okumu Opondo at Acacia Paradise Estate in Kitengela town,” the charge sheet reads.

Appearing before Milimani Principal Magistrate Theresa Nyangena on Tuesday, April 7, 2026, the five denied all the charges, and a plea of not guilty was entered.

The accused persons’ lawyer urged the court to admit his clients to reasonable cash bail to ensure their attendance in court.

Further, the defence requested the court to order the release of phones and cars, property of the accused persons, that were taken from them the day they were arrested.

The prosecution did not oppose the release of the accused persons on bail and bond but urged the court to consider the seriousness of the matter.

“Your honour, I have no instructions to oppose bail and bond, but we pray as the court issues bail and bond terms to consider the seriousness of the matter,” the prosecution submitted to the court.

Notably, the court heard that Kiio Matata, who is the first accused person and currently a member of the KDF in the rank of sergeant, has active disciplinary proceedings at the KDF.

The State argued that considering that he has active proceedings, they are opposed to his release on bond and instead requested he be released to the DOD headquarters to facilitate his attendance and participation in the same proceedings.

Magistrate Nyangena freed the five on a bond of Ksh1 million with a surety of the same amount each, with an alternative of a Ksh500,000 cash bail each.

The matter will be mentioned on April 21, 2026.
