Molo MP Kuria Kimani to table report on 2 tax bills scheduled for second reading

Molo Constituency Member of Parliament (MP) Kuria Kimani, who chairs the National Assembly’s Departmental Committee on Finance and National Planning, will this morning table a report of the Committee’s consideration of two tax bills.

The National Assembly, in a statement shared via X on Tuesday, December 3, 2024, stated that the Kimani-led committee had sat through last night till 5.00 am this morning to comb through the report in readiness for its tabling.

The report features the committee’s consideration of the Tax Laws (Amendment) Bill, 2024, and the Tax Procedures (Amendment) Bill, 2024.

“The Chairperson of the Departmental Committee on Finance and National Planning, @KuriaKimaniMP, is set to table the report of the Committee’s Consideration of the Tax Laws (Amendment) Bill, 2024, and the Tax Procedures (Amendment) Bill, 2024, this morning. The committee, which has processed eight bills in a record two weeks, including conducting public participation in seven counties on six bills, sat through last night till 5:00 am this morning to comb through the report in readiness for its tabling,” the statement reads in part.

The report to be tabled in the National Assembly incorporates the views of the members of the public who gave out submissions on the bills during the public hearings that were conducted across the country.

Second Reading

The Bills will be heading to the second reading today during the National Assembly’s afternoon session.

“As Hon. Kuria Kimani notes in the attached clip, the report incorporates views of the members of the public who gave out submissions on the bills during the public hearings, as well as responses to the views not carried. The Bills are scheduled for second reading this afternoon,” the National Assembly’s statement read.

Kimani on report’s details

MP Kimani confirmed that all the views from Kenyans have been considered in the report, including those from the stakeholders hearings that were held at the Kenyatta International Convention Centre (KICC).

“We are coming to the tail end of our report writing for the three bills, the business laws amendment bill, the tax procedures amendment bill, and the tax laws amendment bill, and we have considered all the views that Kenyans gave us, including all the stakeholder hearings held at KICC,” Kimani Kuria said.

The Tax Laws (Amendment) Bill, 2024, seeks to amend section 3 of the Income Tax in the definition of the term ‘digital marketplace’ by including ‘ride-hailing services,’ ‘food delivery services,’ ‘freelance services,’ ‘professional services,’ etc.

The definition is relevant for taxation of income accruing from business carried out over the internet or an electronic network, including through the digital marketplace.

The proposal is to expand the tax base by bringing the income of the owners of the digital platforms that offer the above services into the tax net.
