Men on violent robbery charge want own statements revoked in court

Three men accused of violently robbing a man of a phone worth Sh19,000 have pleaded with the court to have their statements revoked saying they were brutalized to record them.

The three Antony Wambugu, Yusuf Mwangi Kimotho and Gerald Kangethe Njuguna appeared before Milimani Principal Magistrate Martha Nanzushi and denied the charges.

The three, some who could barely walk in court told Nanzushi that they were dehumanized at the police station where they were forced to record statements after arrest.

“Your honour, we were beaten severely at the police station and we are in pain. We request the court to order the police to take us to hospital for treatment,” they told the court.

The magistrate assured them that their claims of police brutality to force them to record statements would be considered.

 She further assured the suspects that their statements would not be used as evidence as long as they were not given to a police officer above the rank of an inspector.

The three are charged with robbery with violence contrary to section 296 of the Penal Code.

According to the charge sheet, the three on August 22 robbed Brian Kasuva Ngitu of his original ID card, driving license, Insurance Card and one mobile phone valued at Sh19,000 and during the robbery, they threatened to use actual violence against him.

The accused persons were released on a Sh500,000 bond each.

The case will be mentioned on September 9.
