Lawyers seek access to information on Adani, Ketraco deal

Lawyers are now requesting to access information regarding agreements between the Indian firm, Adani Group subsidiary, Adani Energy Solutions and the Kenya Electricity Transmission Company Limited (Ketraco).

In a letter seen by Business Hub, OC Law Advocates LLP has addressed Ketraco’s Managing Director, seeking to exercise their right to access to information regarding agreements between the two parties.

“Our firm has become aware that your organisation is planning to execute various agreements with Adani Energy Solutions (formerly Adani Transmission Limited) to implement various Public Private Partnerships in Kenya,” the letter read in part.

The lawyers are seeking for the project agreements between the two companies, the financial capacity of the tendering company and the tendering process undertaken.

They also wished to access the legal, regulatory, social, economic and commercial viability appraisal, public participation, approval from the attorney general and any undertaking, letter of support, credit or risk guarantee or instrument issued by the ministry within Ketraco’s knowledge.

Transmission project

This letter comes after Adani Energy Solutions secured approval for multi-million- dollar energy transmission project in Kenya under the private-public partnership framework. This approval came amidst heated public debate over another deal involving the Adani Group despite its controversial global track record.

This move sparked fear that the Kenyan government could be opening doors to more than just foreign investment.

It was revealed that the approval was granted after the private-public partnership committee conducted what it described as a ‘thorough evaluation and financial risk assessment’ along with ‘extensive negotiations’ between the two companies.

The lawyers gave the company 14 days to deliver the requested information, failure to which they warned that they shall exercise their rights in accordance with the law.
