Nicholas Gumbo suspended as Kenya Sugar Board Chair

The Employment and Labour Relations Court in Kisumu has temporarily suspended the Chairman of the Kenya Sugar Board, Nicholas Gumbo, from executing any duties pending the hearing of a case filed against him and other respondents.

In the orders issued on March 3, 2026, the court certified the application as urgent and directed that the matter be heard on March 17, 2026.

The case was presented before Justice Nzioki wa Makau at the Kisumu Law Courts.

“This matter is coming up on 3rd March 2026 for direction on the notice of motion dated 27th February 2026 before Honourable Justice Nzioki wa Makau,” part of the court document reads.

According to the court document, the case was filed by Dennis Odhiambo Mugah, Wellingtone Odhiambo Okumu and two other petitioners against the Attorney General, the Chairman of the Kenya Sugar Board and three other respondents.

Justice Nzioki wa Makau ordered that a conservatory order be issued immediately, suspending the first respondent from undertaking any governance, financial, procurement, human resource or administrative policy decisions related to the office of the chairman of the Kenya Sugar Board.

The orders mean that the chairman will not be allowed to perform any functions of the office until the application is heard and determined.

The court further directed that the application be served to all parties for an inter partes hearing scheduled for March 17, 2026.

Justice Makau warned that failure to comply with the court orders could result in penal consequences for any individual found disobeying or failing to observe the directive issued by the court.

The case is expected to proceed later this month when the court will hear submissions from all parties involved before making further determinations.
