Murang’a residents move to court to revoke nomination of 12 MCAs
Four residents from Murang’a have moved to court seeking the revocation of nomination for the Murang’a County Assembly.
Joseph Munyao, Risper Nyambura, Rose Muthoni and Angela Mueni have filed a petition at the Murang’a law court seeking orders to nullify the nomination of the 12 MCAs listing Independent Electoral and Boundaries Commission (IEBC), United Democratic Alliance (UDA), 10 Members of the County Assembly (MCAs) and one interested party as respondents in the petition.
In an affidavit sworn in by Munyao, on behalf of the petitioners, they claim that UDA contravened the law while doing the nominations and thus the nominees don’t deserve to hold the positions.
He said IEBC and UDA published two different lists on gender top-up and the marginalized indicating that they could have been altered.
He also said two of the nominees are not registered as voters in Murang’a county and thus cannot be nominated to the local assembly.
The petitioners further claimed that five out of the 12 nominees come from Kiharu Constituency creating an imbalance for representation in other areas.
“The petitioners retaliate that the county has seven constituencies and as such, it would only have been just and equitable for the nomination slots to be distributed to all constituencies. There was no single person nominated from Gatanga and Kangema” part of the petition read.
Adding;
“In the said agreement,the leaders proposed members who were registered voters in Murang’a county and had been supportive to the party’s campaign to the assembly. The list was countersigned by all said Murang’a party’s leaders.”
They now want the court to nullify the nomination of the MCAs as the due process was not followed while nominating them.
Also, they appealed to the court to order the UDA party to reconstitute the two lists and have the right people enlisted and ensure there is balanced representation in all the constituencies.
The petitioners said earlier last month, the aggrieved residents had raised their grievances regarding the issue urging the UDA party to sort it out failure to which they will go to court.
The MCAs were however sworn in about two weeks ago and assumed various roles in the assembly.
