Gachagua set to address the nation after High Court impeachment ruling

Former deputy president and Democracy for the Citizens’ Party member Rigathi Gachagua is set to address the nation in a press release following the ruling by the High Court that upheld his impeachment on Monday, June 8, 2026.

In a notice on his social media handles on Tuesday, June 9, 2026, Rigathi announced he will have a press conference to address the nation on the ruling at 3:45 pm and is expected to announce his next move after the three-judge bench ruling.

The High Court upheld the Senate’s decision to impeach former Deputy President Rigathi Gachagua, dismissing several consolidated petitions that challenged his removal from office.

In a landmark ruling delivered on Monday, June 8, 2026, by a three-judge bench consisting of Justices Eric Ogolla, Anthony Mrima and Lady Justice Fridah Mugambi, the court found that Parliament acted within the law in the impeachment proceedings and that the process met the constitutional requirements for public participation.

“The court awards constitutional damages of Ksh50 million to His Excellency Gachagua payable by the Senate to vindicate the Constitution, restore the dignity of the affected party, and deter future violations,” the bench stated in its ruling.

Gachagua, who followed the proceedings of his impeachment in absentia from the court, will be giving his sentiments on his next course of action and will be announcing the decision on whether he is going to appeal the judgement in the court of appeal and will also be expected to announce whether he welcomes the move by the judges to order the Senate to compensate him an amount of Ksh.50 for violation of fair trial during the Senate proceedings.

Senate slapped with Ksh50 million compensation

The High Court also ordered the Senate of Kenya to pay former Deputy President Rigathi Gachagua Ksh50 million in constitutional damages, finding that his right to a fair trial was violated during the impeachment proceedings that removed him from office in October 2024.

The three-judge bench comprising Justice Eric Ogola, Justice Anthony Mrima and Justice Dr Freda Mugambi delivered the order as part of its landmark ruling on Monday, marking the first judgement of its kind under Kenya’s 2010 Constitution.

The court issued a declaratory order finding that Gachagua’s fair trial rights were infringed when the Senate declined to grant an adjournment despite his absence from the proceedings.
