Edwin Sifuna makes second attempt to block his removal as ODM SG
By Zipporah Ngwatu, April 8, 2026Nairobi Senator Edwin Sifuna has moved back to the Political Parties Disputes Tribunal (PPDT), seeking orders to block his removal as the Orange Democratic Movement (ODM) party secretary general pending the hearing and determination of his application.
Through a certificate of urgency filed at the Tribunal on Tuesday, April 7, 2026, the senator, through his lawyer, wants the Tribunal to stay the ODM National Executive Committee (NEC) resolution on his removal as the SG on February 11, 2026.
“That pending the hearing and determination of this application, implementation of the resolution made by the National Executive Committee of the Orange Democratic Movement Party on February 11, 2026, to remove Edwin Sifuna as the secretary general of the party be stayed,” part of the application reads.
Further, Sifuna wants the Tribunal to issue conservatory orders blocking all and any proceedings ordered, directed by and flowing from the ODM party’s letter dated April 2, 2026, entitled ‘Notice to Show Cause’.
He also wants an order of injunction to be issued restraining the ODM and the Registrar of Political Parties (RPP) from implementing the NEC’s resolution on his removal or any issues arising from Internal Dispute Resolution Mechanism (IDRM) processes initiated by the ‘Notice to Show Cause’ dated April 2, 2026.
Sifuna argues that the NEC’s resolution was made without the matter of his conduct having been an agenda item of the meeting, without notifying him of any allegations of misconduct made against him, and without giving him an opportunity to defend himself against any alleged misconduct.
In addition, he states that the resolution was thus in breach of the provisions of Article 74 of the ODM Constitution, Section 4 of the Fair Administrative Actions Act, Cap. 7L Laws of Kenya and Article 47 of the Constitution of Kenya and in violation of the complainant’s rights under Article 38 of the Constitution of Kenya.
Through his supporting affidavit, Sifuna avers that it will be a waste of public funds for ODM, being a party funded by public funds, to be allowed to spend money implementing the NEC’s resolution and engaging in what he terms an irregular and fatally flawed process for a predetermined disciplinary action against him.
