2022 polls: Court orders recount of Kajiado gubernatorial race votes

The court has ordered scrutiny and recount of Kajiado gubernatorial race in the August 2022 election.

In a ruling delivered via email on January 10, 2023 by High Court judge Justice JN Mulwa, the court ruled that scrutiny and recount of votes cast in 16 polling stations spread across the county be done.

Two petitioners filed a petition to challenge Governor Joseph Ole Lenku‘s win with five respondents named in the petition.

Deputy Registrar of the elections court has been mandated to preside over the exercise.

Lenku, his deputy Martin Moshisho, and the Independent Electoral and Boundaries Commission (IEBC) Kajiado Returning Officer Festus Mucheke have been named as respondents in the case.

Additional court orders

Scrutiny of used ballot papers, packets of counterfoils, Kiems kit logs, and original declaration forms 37As has also been ordered as well as a recount of rejected votes in the disputed polling stations.

A fresh tallying of results in forms 37A, 37B, and 37C for Kajiado West and Kajiado South Sub-Counties have been ordered.

The outcome of the petition will be the determinant of who bears the cost between the petitioners and respondents.

In the August poll, Lenku garnered 117,600 votes followed by United Democratic Alliance (UDA) candidate Katoo Ole Metito who is now State House Comptroller garnering 111, 725 votes.

David Nkedianye of Jubilee garnered 75,337 votes while Ambrose Kago who vied on an Independent ticket garnered 2, 661votes.
