Beleaguered Kericho Governor to defend himself in Senate via plenary next week

Embattled Kericho Governor Erick Mutai will on Monday and Tuesday next week defend himself before the senate plenary after senators rejected an attempt to form an 11-member special committee to investigate him.

The move came after Nominated Senator Veronica Maina declined to second a motion by Nairobi Senator Edwin Sifuna seeking to form a special committee to discuss his conduct.

Pass Motion

Sifuna had asked the house to pass the motion seeking to have Mutai’s matter discussed in a committee as opposed to the plenary.

He explained that the decision to go the plenary or the committee way was to be made by the Senators since it was not a decision of the leadership to make. He said: “This house is the one that will have the final decision on what to do”

Kakamega Senator Bonny Khalwale wanted Kingi to give members more days to deal with the impeachment motion as opposed to the two days that he had given them.

He said: “We normally create too much pressure on witnesses, parties and this house, I appeal as a matter of justice that because of the tension we create, we should review this since the window we have been given is ten days. What is wrong in you opening up the ruling so that we can take even four days so that senators can inform the house , what they have heard and what is their decision.”

Impeachment motion

Following the move Kingi who insisted that the impeachment motion will be dealt with in the next two days will be heard by the whole House on Monday and Tuesday next week.

Said Kingi: “The motion having lacked a seconder dies naturally.”

He directed the clerk of the senate Jeremiah Nyegenye to issue invitations to the affected parties to appear as well file response by Saturday by 5pm to allow the matter to proceed.

He said: “The parties file their responses by Saturday, October 12, 2014 by 5pm. The clerk to circulate documents received from the parties to all senators by 5pm on Sunday.”

Reads the motion: “The motion having lacked a seconder dies naturally.”

Kingi informed the house that pursuant to Standing Order 48 (3), he had received a Message from the Speaker of the County Assembly of Kericho regarding a resolution of the County Assembly of Kericho for the proposed removal from office of Governor Mutai.
