The withdrawal of Justice Lawrence Mugambi’s security detail has exposed another incident in Mombasa where an MP forcibly entered into a magistrate’s chambers to threaten him over a ruling he had made against her relative.

The Kenya Magistrates and Judges Association (KMJA) yesterday made disclosure of an incident in Mombasa where Likoni MP Mishi Mboko allegedly threatened Kadhi Abdiaziz Maalim Mohamed on September 16.

The Kadhi had made a ruling that appeared to have not been in favour with Ms Mboko’s family and friends.

“Hon. Kadhi Abdiaziz Maalim Mohamed faced a distressing episode at the Mombasa Kadhis Court when MP Mishi Mboko entered his chambers unannounced. The MP, dissatisfied with a decision rendered by the Kadhi in a case involving an alleged relative, confronted him aggressively,” KMJA Vice President Roda Yator said in a statement yesterday.

Constructive dialogue

Yator said the MP’s behaviour aws part of a disturbing trend of intimidation against members of the judiciary.

She said that rather than seeking constructive dialogue, MP Mboko resorted to shouting as she confronted the Kadhi with claims of corruption, targeting not just the Kadhi but the entire Judiciary.

She said the altercation created chaos in the courtroom, as Mboko’s threats and aggressive tactics significantly disrupted the proceedings.

Despite the Kadhi’s attempts to advise the MP on the proper legal channels to address her grievances, the situation deteriorated, attracting members of the public.

Yator said Justice Mubambi’s incident is part of the broader pattern of attempts to undermine judicial independence.

“This episode is more than an isolated incident as it reflects a troubling trend of intimidations aimed at eroding the integrity of our judicial institutions,” Yator said.
