Lawyer Cliff Ombeta representing three suspects linked to the Sh72 million heist from a standard chartered bank ATM claims that they were tortured.

Ombeta told a Milimani court on Monday that the suspects were beaten and tortured by the detectives and even one of them forced to admit that he is a police officer, yet he is not.

The prosecution is seeking to detain the six suspects among them three police officers for seven days to complete investigations into the heist.

The suspects are; Chris Machogi , Duncan Kaveshi Luvunga , Boniface Mutua, Vincent Owuor , Alex Mutuku and Francis Muriuki. 

Lawyer Ombeta, however, opposed the application claiming that the investigating officers have not filed the application in good faith after torturing the suspects.

“The detectives went into the suspects houses and destroyed and broke the ceiling, the toilet and destroyed mattresses,’ Ombeta told the court.

Milimani Chief Magistrate Martha Mutuku was shown how the second suspect Duncan Kaveshi Luvunga, was injured in the head and wrist after being tied with rope and being threatened to be attacked by police dogs.

“If the police are left another one hour with them, they will do damage them.. one of the respondents was pricked with a needle and pepper added to his finger for him to confess that he is a police officer, yet he is not,” Ombeta told the court.

Ombeta asked the court to release the suspects on bail so that they can go seek treatment and in the alternative the court to order that they be taken for treatment.

Magistrate Mutuku will rule at 2.30 today whether to detain them for seven days or not.
