Rules ‘were subverted’ in Sh588m road tender

A former roads official in the Kiambu County government yesterday admitted in court that some of the companies that were eyeing a lucrative Sh588 million tender were disadvantaged after a new evaluation criteria for bidders was introduced.

Lucas Wahinya told Chief Magistrate Thomas Nzyuki of the Milimani Anti-Corruption Court that the serialisation of tender documents was not a criterion in the bid documents.

He said those doing the evaluation felt that serialisation was key to the process. This was then introduced at the evaluation stage.
Wahinya told the court that some of the companies missed the job because of this factor.

“Serialisation wasn’t one of the mandatory evaluation criteria as per the bid document,” he said.

But he insisted that he followed the right process even after Supply Chain Management Director Justus Bundi took issue with the tender after the evaluation committee introduced new criteria for bidders to qualify for the job.

Bundi had told the court that serialisation of tender documents and “form tender” had changed the outcome of the bid.
Form tender captures the sum total of the bid, the name and contact of the bidder.
