Firm ordered to pay sacked workers Sh1m

Three former employees of a security company in Eldoret who were sacked five years ago got a reprieve after the Employment and Labour Relations Court awarded them a total of over Sh1 million in compensation.

While delivering her ruling, Justice Maureen Onyango directed the Managing Director of Radar Security Company Limited Ahmed Hussein to pay the former workers their dues for wrongful dismissal.

The court ruled in favour of the former workers, saying their employer sent them packing without a  fair hearing.

Justice Onyango ruled that Geofrey Wanjofu, Eric Musonye and Victor Osewe get damages of Sh360,765 each.

According to the judge, the awarded sum of money will attract interest at court rates from the date of judgment until payment is made in full.

On January 7, 2022, the former employees, through the Kenya National Private Security Workers Union, moved to court demanding compensation for wrongful dismissal, retirement benefits, unpaid dues and allowances.

In their suit, they argued that their employer sacked them without a fair hearing after they were accused of inciting their colleagues to go on strike over salary delays.

Their former employer claimed in the court papers that the guards incited their colleagues to strike, causing disturbance and paralyzing operations at their client’s factory where they had been assigned to guard.

“I enter judgment for the claimant against the respondent as prayed and award each of the aggrieved former workers Sh360,765. I further award the claimant Sh50,000 on account of reasonable reimbursement costs and necessary expenses of the suit,” ruled Justice Onyango.
