Court bars lawyers from Cohen case
The High Court has barred a city law firm from participating in all cases concerning the widow of Tob Cohen, Court of Appeal judge Sankale ole Kantai and DPP Noordin Haji over the Dutch tycoon’s murder.
Judge Hedwig Ong’undi yesterday barred all advocates of Musyoki Mogaka & Co. Advocates, including lawyers Danstan Omari and Shadrack Wambui from participating in the cases.
Advocates were representing Cohen’s sister, Gabrielle Hannah van Straten in various cases lodged at the High Court by the DPP and Justice Sankale. In the petitions, the advocates have been disqualified from appearing, including in a lawsuit filed by Justice Sankale challenging a decision by the Judicial Service Commission to act against him after he was implicated in Cohen’s murder. DPP had also filed a petition questioning the powers of Public Service Commission to handle a complaint lodged against him over his alleged failure to prefer murder charges against Judge Sankale.
Wairimu, through lawyer Phillip Murgor asked the court to bar the advocates over conflict of interest on grounds that Omari and Wambui have played an active role in the probe in respect of the murder of her husband. While barring the lawyer from representing Gabrielle, Judge noted that from evidence adduced in court, Omari, Wambui and the law firm have played a critical role in the murder case.
