East African Court of Justice ready to hear Sonko’s impeachment case

The East African Court of Justice has set Monday, 27, 2023, as the hearing date of former Nairobi Governor Mike Sonko‘s impeachment case.

In a notice on Wednesday, February 8, the court said it was ready to hear the case whether parties in it appear in court or not.

“Take notice that the above application has been fixed hearing on Monday the 27th day of March 2023 from 9.30 a.m. before Honourable Mr. Justice Yohane B. Masara — Principal Judge, Honourable Justice Dr. Charles Nyawello, Honourable Mr. Justice Richard Muhumuza, Honourable Mr. Justice Richard Wabwire Wejuli and Honourable Justice Dr. Gacuko Leonard in open Court, 2nd Floor, EAC Headquarters, Afrika Mashariki Road EAC Close, Arusha.

“Please note that if there is no appearance on your part, the court will proceed to hear the case and make necessary orders your absence notwithstanding,” the court’s Deputy Registrar said in the notice.

The court listed Kenya’s Attorney General as a respondent.

Sonko appeals Supreme Court decision

In July last year, the former governor has filed an appeal at the East African Court of Justice to challenge the decision of Kenya’s Supreme Court that upheld his impeachment over abuse of office allegations.

While lodging the appeal, Sonko said the decision of the Supreme Court and courts of Kenya was arrived at in an unjust manner.

Its effect, he said, was to curtail his political rights and the people he represented.

“The decision of the Kenyan judicial arm is tainted with illegality as the decision of the high court as upheld by the Supreme Court was influenced through corrupt means,” he said.
