Chitembwe tribunal goes on, to proceed expeditiously
The Tribunal formed to investigate the conduct of High Court Judge Said Juma Chitembwe yesterday said the hearing, which commenced on September 19, is still ongoing and will be conducted expeditiously.
In a statement released by its Joint Secretaries Sarah Yamo and Jasper Mbiuki, the tribunal said it would continue to inquire into the matter without compromising the Judge’s right to due process and a fair hearing.
“In line with the requirements under Article 168(7)(b) of the Constitution and the Second Schedule to the Judicial Commission Act,” read the statement.
The tribunal which is being chaired by Justice Mumbi Ngugi consist of Senior Counsel Fred Ojiambo, Justice Abida Ali Aroni,Justice Nzioki wa Makau, James Ochieng’ Oduol, Retired General Jackson Ndung’u and Dr Lydia Nzomo.
Senior Counsel Kiragu Kimani is the lead counsel in the matter while Joseph Gitonga Riungu and Edward Nyang’au are the assisting Counsels.
The statement released yesterday indicated that the tribunal had held its inaugural meeting on May 25 to discuss the preliminary matters necessary for the just and expeditious conduct of the inquiry, including the preparation and publication of the Tribunal’s Rules of Procedure
“Hearing of the matter commenced on 19th September 2022 and is ongoing. Paragraph 19 of the Second Schedule to the Judicial Service Commission Act requires that the decision of the Tribunal with regard to the ongoing inquiry shall be delivered in public on a date fixed for that purpose but no later than 14 days after the conclusion of the proceedings,” read the statement.
JSC on May 4 sent its Petition to the President to form a tribunal to probe the conduct of the Judge over leaked video footage by former Nairobi Governor Mike Mbuvi Sonko, which shows the Judge discussing how to compromise a case.
