The Anti-Corruption Court yesterday warned it will discharge former Football Kenya Federation (FKF) Nick Mwendwa in his Sh38 million corruption case.

Move came yesterday after the Director of Public Prosecutions revealed that crucial evidence in possession of senior government officials and a bank has not been availed.

Trial Magistrate Eunice Nyutu gave the DPP seven days to get the evidence from Sports Cabinet Secretary Amina Mohamed, her PS Joe Okudo and a Kenya Commercial Bank manager, failure to which the DPP withdraws the case. Nyutu warned the DPP against using the court to aid in finalising investigations against the former FKF boss.

“This court will not allow the DPP to use it in assisting him to finalise investigations in the case.” Nyutu stated. “Investigations should always be completed before arraigning a suspect.”

Magistrate advised the DPP to terminate the case to pave way in-depth investigations instead of piecemeal proceedings. Case will be mentioned on February 4 for the DPP to give court the way forward.
